Calculate financingExactly, the liability for material defects is an important consumer right and protects buyers in transactions with traders or entrepreneurs. Here is a brief overview of the main points:
- Liability for material defects (often also referred to as warranty) always applies to contracts between a retailer/company and a private individual.
- Duration: As a rule, the liability period is two years, whereby the dealer is liable for defects that were already present when the vehicle was handed over. However, this period can be shortened to at least one year for used vehicles.
- Reversal of the burden of proof: Within the first six months, it is assumed that an identified defect already existed at the time of delivery, unless the dealer can prove the opposite.
Liability for material defects can therefore not simply be excluded if an entrepreneur sells to a private individual. It also differs from a warranty, which is offered voluntarily by the dealer or manufacturer and may include additional services.
